The Delhi High Court on Tuesday directed OpenAI, the company that owns the conversational Artificial intelligence model ChatGPT, to appear before the court in a civil case filed by news organisation Asian News International (ANI) regarding the use of its news content “without any license or permission” by the sophisticated AI-based chatbot.
In its latest complaint, ANI accused OpenAI of interfering with its business relations by appropriating its materials and using them to train the chatbot, without any permissions for the same.
It further contended that OpenAI illegally cached its materials which it eventually used to develop the Large Language Model (LLM) that produces responses that “substantially replicate or reproduce the Plaintiff’s (ANI) Works”.
“Such outputs incorporate verbatim substantial and even reproduce the style of the Plaintiff’s Works without permission. That constitutes the clear violation of the copyright of the Plaintiff’s Works,” the application by ANI said.
This is the very first case of such kind of copyright infringement against OpenAI from Indian news media.
However, in the US, the company has come under copyright infringement claims from various US-based newspapers such as The New York Daily News and Chicago Tribune that have accused it of training its LLM on copyright-protected news articles without receiving any sanction or compensation.
